The amendment of Chapter 12 of the Swiss Private International Law Act, after more than three decades, on 1 January 2021, as well as the revision of the Swiss Rules of Arbitration and the significant institutional changes introduced to the Swiss Arbitration Centre at the beginning of June 2021, mark the beginning of a new era for international arbitration in Switzerland. The amendments seek to bring both the Swiss PILA and the Swiss Rules up to date with the most recent trends in the field of international arbitration. While the changes to both could have been more extensive, the Swiss PILA and the Swiss Rules maintain their user-friendly characteristics, with an emphasis on party autonomy and with a view to strengthening Switzerland’s position as a one-stop-shop for the resolution of international arbitration disputes.
